DATA PROTECTION FACTSHEET AND PROCEDURE
Introduction
At Fast Blood Test, we understand that when customers provide us with their personal information, they expect us to respect, protect, and manage it responsibly. We have both a legal and ethical obligation to ensure that all personal data is handled appropriately and safeguarded from unnecessary risk.
What Is Data Protection?
The General Data Protection Regulation (GDPR), which came into effect in May 2018, replaced the Data Protection Act 1998. GDPR strengthens and modernises data protection standards by:
a) Enhancing individuals’ rights over their personal data
b) Protecting individuals from the misuse or mishandling of their personal information
c) Providing individuals with the right to be forgotten
The Information Commissioner’s Office (ICO) enforces GDPR and has the authority to impose significant penalties for non-compliance. Certain actions constitute criminal offences, including:
a) Accessing personal data without authorisation (e.g., viewing someone else’s medical records)
b) Obtaining, disclosing, selling, or advertising personal data without the Data Controller’s permission
Why Is Data Protection Important?
If personal data is mishandled or accessed by unauthorised individuals, it may be used for identity theft, fraud, and other financial crimes. Such breaches can have serious consequences for both individuals and the wider economy. Proper data protection helps prevent these risks.
What Is Personal Data and Sensitive Personal Data?
Personal data refers to information relating to a living individual who can be identified from that data alone or in combination with other information in someone’s possession. This includes factual details as well as recorded opinions.
Sensitive personal data includes information regarding a person’s:
Physical or mental health
Sexual life
Racial or ethnic origin
Political opinions
Religious or similar beliefs
Trade union membership
Actual or alleged criminal offences and related proceedings
For the purposes of this document, the term personal data includes both standard personal data and sensitive personal data. At FBT, all data is treated with the same high level of protection.
What Does GDPR Mean for Fast Blood Test?
We are committed to upholding the eight specific individual rights under GDPR:
1. The Right to Be Informed
Organisations must provide clear information on how they collect and process personal data. FBT ensures this through our Data Privacy Policy.
2. The Right of Access
Customers can request access to the personal data we hold about them through a Subject Access Request. We must respond within one month.
3. The Right to Rectification
If any information we hold is inaccurate or incomplete, customers have the right to request corrections (e.g., name spelling, date of birth).
4. The Right to Erasure
Customers may request that we delete all personal data we hold about them, especially if consent is withdrawn or if there is no legal basis for continued processing.
5. The Right to Restrict Processing
Individuals can request that we limit how their data is used. In such cases, we may store the data but cannot process it further, except to maintain the restriction.
6. The Right to Data Portability
Individuals can request to receive their personal data in a structured format or have it transferred to another organisation.
7. The Right to Object
Customers may object to the processing of their personal data if there is no legitimate reason for it to be collected (e.g., unnecessary requests for salary information).
8. Rights Regarding Automated Decision-Making and Profiling
GDPR safeguards individuals against significant decisions being made without human involvement.
If any of these rights are not upheld, the Fast Blood Test Head Office must be notified immediately.
